Just a few more reasons not to get a DUI in Texas

The state of Texas has one of the highest rates of DWI accidents and deaths in the nation.

Texas law can convict felons with a BAC of 0.08 and can also cite felons for having less than that in their system.

If a police officer stopped you and asked you to take a breathalyzer test, it would be in your best interest to comply because if you refuse, he has the authority to take away your license, then and there. This suspension can be up to 6 months and that is without counting the sentence ordered by the court, if he is convicted, from 90 days to one year.

If you are not 21 and are caught driving while intoxicated, Texas law will grant you a sixty day license suspension, a possible maximum $500 fine, and some community service. [20-40 hrs.]. Attending an alcohol awareness class is required.

But if you had 0.08 or more BAC, you would receive the same penalties as anyone over the age of 21, plus another underage charge.

Hopefully his first offense would teach him a lesson with a maximum $2,000 fine, 72 hours to 90 days in jail, and his license suspended for 90 days to a year. But if that didn’t wake him up, the second time would pretty well give him a double dose of the above, with a maximum fine of $4,000, double jail time, and without his license. Third time offender has a maximum fine of $10,000, up to 10 years in jail maximum, and up to 2 years of suspended license.

All of the above depends on the seriousness of the infraction. Ultimately, the judge makes the decision about what punishment he will receive.
